What is conveyancing?

No, these days all land property transactions are conducted in Property Exchange Australia or PEXA. PEXA is an electronic platform which looks after all e-conveyancing transactions in Australia.

In Victoria paper titles as we once knew them have been phased out completely with land titles now being held by electronically by conveyancers, lawyers or a bank (where there is an existing mortgage).

The manner of how you hold property in Victoria is a matter for the individuals. In short for a couple purchasing a property in equal shares they can do so as either "Joint proprietors" or "Tenants in Common"

  • Joint proprietors - means you both own the property as one, and upon the death of one party the property will vest or go to the surviving party by way of a survivorship application. The property will not form part of either of the party’s wills.

  • Tenants in Common - this manner of holding allows for either party to own a certain percentage of the property depending on factors such as the amount of funds allocated to the purchase price etc. One party may own 50, 60 or 70 percent of the property while the other owns the remaining percentage. Both of you own your share of the property in your own right, and can sell their share at any time. The property, in this instance, does form part of each party’s wills. Yes, you can. We can assist with an adverse possession application.

The legal test sets out if you can demonstrate uninterrupted and exclusive possession of that land for the past 15 years, to the exclusion of the owner of that land. If you have been paying the rates for the past 15 years as well as treated the land as your own, for an example provided fencing and maintenance, these are all factors which support your application for adverse possession.

Unfortunately, the process is not a quick one and may take time, particularly if a survey is necessary. The time can vary on each application however from commencement to the final assessment can take approximately 3 – 6 months.

A fixed price cost can be discussed at the time of our first meeting, depending on the necessity for a survey, the size of the land, and whether the land consists of Torrens land as well as General Law land.
