What is Family Law?
Family law is the area of law that deals with legal matters involving family relationships. It’s a deeply personal area of law, and outcomes can significantly affect people’s lives—especially children. That’s why many people seek legal advice or representation from a family lawyer to help navigate the process.
The main legislation governing family law in Australia is the Family Law Act 1975, and most matters are handled by the Federal Circuit and Family Court of Australia.

It is always best to conclude your property settlement before you apply for your divorce. There are two possible documents you can use to set out your agreement, either "Consent Orders" or a "Binding Financial Agreement".
Consent Orders - are final and are filed with the Family Court. These orders are vetted by the Court to ensure they are fair and then filed with the Court.
Binding Financial Agreement (BFA) - you can agree to a Binding Financial Agreement which is in line with an agreement between parties, although binding it is not filed in the Family Court and not vetted by the Court.
